Terms and Conditions Exceptional Tutoring

1. Payment- The client agrees to pay Exceptional Tutoring ACS LLC the agreed amount upon package or hourly rate for both tutoring and academic coaching services. The client  understands that he/she will be charged for sessions in one hour increments. Clients will pay bills via Check, Paypal, or at www.exceptionaltutoringacs.com. Client will not be refunded for missed sessions without prior notice unlessed specified and approved by the Director of Exceptional Tutoring Service

2. Cancellation- All cancellations should be arranged with us at least 24 hours prior to the scheduled session. It is your responsibility to contact our office via phone or voicemail to cancel a session. If you did not contact our office within a 24 hour notice, re-schedules/sub sessions cannot b guaranteed.

3. Location- The client will choose from In-home, online, or center based tutoring for all sessions.

4. Obligations of the Client- The client will provide necessary information to the tutor to correctly identify the areas the student requires specific tutoring. The client agrees to provide all necessary materials needed for tutoring sessions (i.e., notebook, computer, writing utensils, etc.).

5. Scheduling Time- All scheduling must be done via phone. Our voicemail box is open 24 hours and we will be sure to return any missed calls outside of business hours within the next business day.

6. No Guarantees or Warranties- The client understands that Exceptional Tutoring ACS does not guarantee any specific outcomes as a result of tutoring. A tutor will be provided to help the student succeed. The rest depends on the student and parent.

7. Waiver of Negligence- The client waves any negligence on the part of Exceptional Tutoring ACS regarding the hiring or supervision of the tutor, or the tutor’s actual conduct.

8. Limitation of Liability- In the event of litigation, Exceptional Tutoring ACS’s total liability shall not exceed the amount of money client paid Exceptional Tutoriong ACS for services rendered.

9. Termination- This tutoring  contract may be terminated by either party at any time by giving the other party a seven day prior written notice.

10. Minors- Where the student is a legal minor, the Parent/Guardian shall enter into this tutoring contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student.

11. Merger Clause-This contract represents the complete agreement between the client and Exceptional Tutoring ACS. It can only be modified in writing. The website is not part of the contract.
